Agustín Azparren recently joined ONTIER Spain to lead the Mediation department. He was interviewed by the local daily La Nueva España, and told that Mediation is his true passion.
Agustín Azparren states that in Spain ''there's a litigation culture'' which he believes must change in time. That's why mediation exists, he explains, and ''it makes it possible for both people and the State to save resources''. Mediation also makes it possible to reach a peaceful resolution for any conflicts and eases Court overcrowding.
But according to Azparren, the problem is that ''most people don't know what mediation is. Actually, many lawyers think it's bargaining''. The barrister states that the true value provided by mediation is that a third independent party is involved, making it possible to reach a solution without getting to Court''. This makes it possible to save resources and avoid concerns. ''In Court it may take years to reach a solution, whereas mediation can solve almost any problem in 1-2 weeks'', he explains.
Regarding his expertise as a Judge, Azparren believes that ''every judge should experience the law firm practice. Staying close to people and clients provides you with a bigger picture of how things happen and why''.
Agustín states: ''If I ever went back to the Judgeship I would keep on working until law compels me to retire at 70-72. I love my job, therefore I don't ever think of retiring.''
